Challenges in Revising Law No. 39 of 1999 on Human Rights from the Perspective of Strengthening Human Rights Protection in Indonesia

Abstract
The revision of Law Number 39 of 1999 on Human Rights has become an important agenda in the reform of Indonesia’s national legal framework in response to developments in constitutional law, international human rights law, technological advancement, and the growing complexity of human rights issues in Indonesia. This study aims to analyze the urgency and challenges surrounding the revision of Law Number 39 of 1999 and to examine the direction of its reform from the perspective of strengthening human rights protection in Indonesia. This study employs normative legal research using a statutory approach and a conceptual approach. The legal materials consist of primary, secondary, and tertiary legal sources, which were collected through a literature review and analyzed using descriptive qualitative methods and juridical reasoning. The findings indicate that the revision of the Human Rights Law is necessary due to developments in the constitutional system, the evolution of national and international human rights instruments, and the emergence of contemporary human rights issues, including the protection of rights in the digital sphere. However, the revision process faces several challenges, particularly concerning the distribution and strengthening of the powers of human rights institutions, the expansion of governmental authority, human rights enforcement mechanisms, the protection of human rights defenders, and public participation. Therefore, the revision of the Human Rights Law should be directed toward strengthening substantive and institutional frameworks, improving the effectiveness of human rights enforcement, protecting vulnerable groups, and implementing the principle of meaningful participation. Such reform must ensure that the revision does not result in regression in the protection of human rights that has already been established.
