The Effect of Alcohol Consumption on the Occurrence of Criminal Assault From the Perspective of Criminal Law
Main Article Content
Abstract
Alcohol consumption is a social issue that can have various impacts on society, including an increased risk of violence and assault. Intoxication resulting from alcohol consumption can impair an individual's ability to control their emotions and behavior. This study aims to analyze the influence of alcohol consumption on the commission of assault and to examine the criminal liability of perpetrators who commit such acts while under the influence of alcohol. The study employs an empirical legal research method, utilizing both statutory and conceptual approaches. Data were gathered from primary and secondary legal sources, as well as empirical data relevant to the research problem. The findings indicate that alcohol consumption can be a contributing factor to assault, as it diminishes self-control, heightens emotions, and impairs the ability to consider the consequences of one's actions. However, alcohol consumption is not the sole cause of assault; other factors such as personal conflicts, jealousy, misunderstandings, perceived slights, and social environment also play a role. In principle, perpetrators who commit assault while intoxicated remain criminally liable, as voluntary intoxication does not automatically negate culpability or criminal responsibility. Therefore, addressing alcohol-related assault requires an integrated approach combining penal and non-penal policies.
